2. YOUR STATUS
2.1 By placing an order through our site, you warrant that:
2.1.1 you are legally capable of entering into binding contracts; and
2.1.2 you are at least 18 years old.
3. CONDITIONS
3.1 Any order for products placed by customers through our website shall be subject to these terms and conditions.
3.2 All other terms and conditions expressed or implied by statute or otherwise are excluded to the fullest extent permitted by law.
3.3 Nothing in these terms and conditions shall affect the statutory rights of any consumer.
4. ORDERS
4.1 All orders for products shall be deemed to be an offer by the customer to purchase products pursuant to these terms and conditions.
4.2 You should understand that by ordering any of our products, you agree to be bound by these terms and conditions.
4.3 No order submitted by the customer shall be deemed to be accepted by us unless and until we confirm acceptance of your order. The order will be processed once payment for the order is received. All orders are subject to availability.
4.4 We reserve the right to refuse any order placed by you and will not be required to provide an explanation.
5. PRODUCTS
5.1 The products may differ slightly from the images shown on the website. Sizes and measurements are approximate only.
6. PRICE AND PAYMENT
6.1 The price of the products will be the price quoted on the website at the date the order is received.
6.2 These prices will include VAT but exclude delivery costs, which will be added to the total amount.
6.3. By placing an order you, the customer, consent to payment being charged to your credit/debit/PayPal account (or other permitted payment method) as provided.
6.4 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.
6.5 Title to the products will pass to the customer on payment in full of the price of the products.
6.6 We will issue you with an electronic receipt to your email address once the transaction is completed and will send you a further email and tracking number once the products have been dispatched.
7. IMPORT DUTIES
7.1 If you order products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
7.2. Please note you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.
8. REFUNDS AND EXCHANGES POLICY
8.1.If you would like to return an item and it is in new, unused and saleable condition then you will need to email us at studio@tommyzhong.com to let us know that you’d like to make a return. Please quote your order number, the item name and SKU code.
8.2 Please fill out the returns form you received with your order to let us know the reason for return and enclose the completed form with the item you’d like to return.
8.3 You must arrange your return shipment and you are responsible for the full cost of the return shipment, including taxes and duties levied upon entering the country. You will need to email us your chosen shipping provider and the tracking number. We are not responsible for any returns shipments but you must let us know the details of the shipping information. You will need to send multiple copies of the commercial invoice, and any other required shipping documents with the returned item to ensure there are no customs clearance issues. We regret that we cannot be held responsible for customs issues or anything lost, damaged or delayed in transit.
8.4 Once we receive the returned item that you’d like to exchange, we will check for wear and tear and that the item is in new, unused and saleable condition. Once approved, we will email you and refund you within 30 days following receipt of the returned item.
8.5 You can make a return within 14 days of receiving your online shop order. The 14 days begin the day after you receive the products.
8.6 All items must be returned in their original condition via the steps outlined below.
8.7 Merchandise must not be worn, altered or washed and must be returned in its original condition accompanied by its tags. Merchandise showing any sign of use will not be accepted and will be sent back to the customer at the discretion of “TOMMY ZHONG”
9. LIMITATION OF LIABILITY
9.1 We will use all reasonable endeavours to carry out its obligations within a reasonable period of time but will not be liable to you, the buyer for any loss, costs or expenses arising directly or indirectly from any delays in doing so and we will not be deemed to be in breach of this Agreement by reason of any delay in performing, or any failure to perform, any of our obligations in relation to this Agreement if the delay or failure was due to any cause beyond our reasonable control. Without prejudice to the generality of the foregoing, the following will be regarded as causes beyond our reasonable control:
9.1.1 Act of God, explosion, flood, tempest, fire or accident;
9.1.2 War or threat of war, sabotage, civil disturbance or requisition;
9.1.3 Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority;
9.1.4 Import or export regulations or embargoes;
9.1.5 Strikes, lock outs or other industrial actions or trade disputes;
9.1.6 Difficulties in obtaining raw materials, labour, fuel, parts or machinery;
9.1.7 Power failure or breakdown in machinery. If we are prevented from carrying out our obligations in the above circumstances, we will notify you in writing. If we are still prevented from carrying out our obligations 3 weeks from the dated such notice was sent, then either party may give written notice to the other cancelling the Agreement. If the Agreement is cancelled in this way we accept no liability to compensate you for any loss or damage caused by failure to perform.
9.2 Except in respect of death or personal injury caused by our negligence, we will not be liable to you, the buyer, for any loss of profit or any indirect special or consequential loss, damage, costs, expenses or other claims, which arise out of or in connection with the supply of products other than as a result of a breach of an obligation arising under the Sale of Products Act 1979 (as amended) and the Supply of Products and Services Act 1973.
10 GENERAL
10.1 English law will apply to this Agreement and the parties agree to submit to the nonexclusive jurisdiction of the English courts.
10.2 If any provision of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of this Agreement and the remainder of the provision in question will not be affected.
